The meeting opened at 7:00 PM. George agreed to serve as Board Chair in Ginny’s absence.

Review of July 1 Minutes: Doug motioned to accept the July 1 Minutes. Sally seconded. All in favor.

Removal of Old Residence and Construction of New Residence

The Pineau’s were back again with a change of plans. During the June 3, 2008 Planning Board Meeting, a seasonal conversion and replacement of the foundation was approved for their structure located at 132 Arnold Rd. They now are proposing to remove the current structure and build a new structure more than 100 feet from the high water mark of Webber Pond. In order to do so, Arnold Rd must be re-located and the property line in-between lots 19&20 and 21 must be re-located so that the new structure is entirely on lots 19&20. The re-location would involve transferring a strip of land 40 feet wide from lot 21 to lots 19&20.

Bruce Arnold, who maintains the Arnold Road for its Road Association was attending the meeting and expressed some concern, mainly due to the fact that no road plans were made yet and the road needed to be wide enough for emergency vehicle access. The Pineau’s said that they were willing to work with the Road Association and that the road will actually be wider than what currently exists. There are two additional properties beyond the Pineau lots that would be affected by the road re-location.

Doug asked Paul a question pertaining to lot non-conformity. Would the land transfer make one of the lots more non-conforming? Paul answered that Vassalboro’s Shoreland Zoning Ordinance specifically prohibits lot divisions that causes a non-conforming lot to become more non-conforming. The transfer of this land is not a land division and hence is legal. The conversion of the current non-conforming structure to a conforming structure will result in more conformity when considering the Pineau’s abutting lots, collectively.

The application was considered complete by motion of Doug, seconded by Sally. All in favor. Doug made a motion to approve the performance standards and permit as a whole, seconded by Sally. All in favor.

Green House / Pick your Own Vegetable Business
Minor Site Review
Tax Map 10, Lot 29

Rhona is applying for an after the fact permit for an agricultural business located at 88 Nelson Rd. Currently a 20 X 36 greenhouse exists on the property and a 30 X 72 greenhouse is planned in the near future. Vegetable and plant seedlings, hanging baskets, and the like are currently sold. Pick your own vegetables are also sold there. Doug said that since items are actually sold, permitting is required by Vassalboro’s Site Review Ordinance. Sally asked if all the green card receipts had been received from abutters. There is one abutter in which one green card had not been received.

George went through the ordinance criteria for the site plan. The application was determined to be complete conditionally, subject to receiving the last green card receipt by motion of Doug, seconded by Sally. All in favor.

Next the performance standards for a minor site review were considered as follows.


1.Provisions for vehicle loading and unloading. - No significant issues. Motion for approval by Sally. Seconded by Doug. All in favor.
2.Location of height and location of proposed structures and uses not detrimental. No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
3.Provisions for on-site landscaping, screening, and buffering from adjoining neighborhood. - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
4.The proposed use will not impact public facilities such as the capacity of sewers, storm drains, water, solid waste, and fire protection. - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
5.Adequate provisions for stormwater - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
6.Adequate provisions to prevent soil erosion and impacts to ground and surface water. - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
7.Adequate provisions that exterior lighting to not provide hazards to motorists and adjacent properties. - No significant issues. Motion for approval by Sally. Seconded by Doug. All in favor.
8.Evidence for financial capacity. - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
9.The proposed development will not create safety hazards and provide adequate access for emergency vehicles. No significant issues. Motion for approval by Sally. Seconded by Doug. All in favor.
10.Adequate provisions to insure noise, vibrations, fumes, odor, dust, and glare are not detrimental to neighborhood. - No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.

The site review permit as a whole was approved conditionally subject to receiving the last green card receipt from an abutter by motion of Doug. Seconded by Sally. All in favor.

Cassie and Paul Lee
Minor Subdivision
McQuarrie Rd
Tax Map 5, Lot 97A

The Lee’s purchased a four acre plot from Shirley McQuarrie on the Mcquarrie Rd which is a portion of the land that was for sale. Their plan to put two dwelling units on this lot created a minor subdivision, since the remaining land for sale is the third lot. Doug questioned whether this should be the Lee’s subdivision or the McQuarrie’s. Paul said the actual dividing of the Lee’s lot created the second and third lots so they are responsible for obtaining subdivision approval from the Planning Board. The land that the McQuarries were selling was indicated as a single lot on the Town’s Tax Map system. No land boundary survey had been completed by the McQuarries for the Lee plot and hence the division had not occurred until permitting for dwelling units was applied for to the Town.

George proceeded to go through the 28 items for the minor subdivision application requirements. The material provided by the Lees was well organized and separated by each numbered item. The application was considered complete by motion of Doug, seconded by Sally. All in favor.

Next the performance standards of the Subdivision Ordinance were reviewed for compliance.


A.Pollution – No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
B.Sufficient Water – Covered by a letter from a well driller familiar with the area. Motion for approval by Sally. Seconded by Doug. All in favor.
C. Soil erosion – Submission of material contains adequate erosion control measures. Silt fence and road ditch check dams proposed. Motion for approval by Doug. Seconded by Sally. All in favor.
D.Traffic Conditions –No significant issues. Motion for approval by Sally. Seconded by Doug. All in favor.
E.Sewage Disposal – Submittal of lot test pits and both HHE-200 forms with subdivision application. Motion for approval by Doug. Seconded by Sally. All in favor.
F.Solid Waste - No issues identified. Motion for approval by Doug. Seconded by Sally. All in favor.
G.Impact of Natural Beauty - No issues identified. Motion for approval by Sally. Seconded by Doug. All in favor.
H.Financial and Technical Capacity – No significant issues. Motion for approval by Doug. Seconded by Sally. All in favor.
I.Impact on groundwater quality or quantity. No issues identified. Motion for approval by Doug. Seconded by Sally. All in favor.
J.Flood Plain Management – Not in a flood plain. Not applicable. Motion for approval by Sally. Seconded by Doug. All in favor.

L.Storm Water Management – Propose to maintain vegetative buffer downslope of development and nearest to Webber Pond. Stone check dams within road ditch will slow down flow of storm water. Motion for approval by Doug. Seconded by Sally. All in favor.

Sally made a motion to approve the subdivision application in its entirety, seconded by Doug. All in favor.

It was decided that the Planning Board will meet next on September 2.
