Expansion of Non-conforming Structure
Map 18 Lot 9
An expansion of a non-conforming structure with water frontage on Webber Pond is proposed. This was approved on September 18, 2018 but the approval has expired.

 

• Applicant proposes 10 x 11 addition and demolition of shower room. Total expansion 92 SF.
• Application indicates proposed footprint is 1491 sf; allowable footprint with 30% rule is 1832 sf.
• CEO Mitnik indicates calculations are in error but they still meet the 30% limit easily. Total footprint of nonconforming structures is 821 sf. 913 sf proposed. 1067 sf allowed.
• Application approved by motion of Betsy Poulin; seconded by Doug Phillips by 4-0 vote.

B. Jeremy Soucy

Automobile Sales

Map 1 Lot 129

Automobiles Sales is proposed at the former site permitted to Randy Raynes.

• Applicant purchased lot in January of this year, also lives on site.
• Has experience in automobile sales and is aware of state licensing requirements
• Ginny indicates that the site plan and application should indicate lighting, signs, access to site, buffering, hours of operation, number of cars on site.
• Parking on Route 201 potential issue.
• Will submit full application next meeting. CEO Mitnik indicates the deadline for applications is two weeks prior to meeting. He can review application for completeness if application is submitted before this deadline.

Medical Marijuana
Old Meadow Ln
Map 2 Lot 87-14 and 87

• Two 28 x 144 building to grow medical marijuana and one 28 x 28 storage building
• The buildings will be rented to potential growers
• One 28 x 144 building is on Map 2; Lot 87-14; the other buildings are on lot 87. These lots are at the end of Old Meadow Rd; a subdivision with mostly mobile homes
• CEO Mitnik indicates that the return receipts were submitted to provide proof of abutter notification
• Planning Board Chair, Ginny Brackett, indicates that the plan needs to be drawn to scale; in particular the width of the driveway is 20 ft and is illustrated by only a line on the plan
• Mike Vashon of VFD indicates that turn arounds at the ends of the road should be indicated. Important issue for FD. Dimensions need to be included on plan.
• Board wants buildings included on the contour illustration
• CEO Mitnik indicates that a bathroom for each grow building and a septic systems are required as part of the plumbing code for the commercial building. Porta potties proposed are not an acceptable alternative for long term usage as part of the code.
• Applicant did not know if buildings would be rented by separate individuals or indicated the possibility of two entities within a single building.
• An abutter was concerned about security and property values.
• Applicant requested that this application be reviewed at this meeting due to similarity with one already approved by Board.

Map 4 Lot 27-A
• Two 28 x 144 building to grow medical marijuana and one 28 x 28 storage building
• The buildings will be rented to potential growers
• The buildings will be on Map 4, Lot 27-A; a large lot on the end of Sherwood Lane. The road to the proposed buildings is private and gravel and a ranch exists where Andrew Barnett lives.
• CEO Mitnik indicates that the return receipts were submitted to provide proof of abutter notification
• Planning Board Chair, Ginny Brackett, indicates that the plan needs to be drawn to scale; in particular the width of the driveway is 20 ft and is illustrated by only a line on the plan. Driveway is 20 x 70 feet.
• Mike Vashon of VFD indicates that turn arounds at the ends of the road should be indicated. Important issue for FD. Dimensions need to be included on plan.
• Board wants buildings included on the contour illustration
• Abutter indicated that odor from plants are a potential issue. Want odor mitigation. Applicant indicated that odor is not detectable within 100 feet of buildings.
• Another abutter complained about increased traffic on Sherwood Lane.
• Most of Sherwood Lane is a subdivision with a Town Road. The end of it turns into a gravel private road which will provide access to the proposed facilities.
• Abutters were concerned about security

Due to the large amount of public comment at the meeting and large amount of written testimony, the Board decides to hold a public hearing on both Barnett application. CEO Mitnik is in the process of using St Bridget’s Center at 864 Main St for this meeting to accommodate the large amount of people expected. The decision on these applications is tabled.
